These Terms and Conditions apply to all of our services. By visiting our website, purchasing our services and/or entering our classes, you agree to our Terms and Conditions.

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by English Law and the Courts of England.

Please read these Terms and Conditions carefully before purchasing our services. Print a copy for your records, and check for updates.

General Conditions

At our sole discretion, we reserve the right to update, change, replace or discontinue any part of these Terms and Conditions, policies, pricing, memberships and services at any time by posting updates and/or changes to our website without notice. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or service following the posting of any changes constitutes acceptance of those changes.

Any new features or tools added to the current website are also subject to the Terms and Conditions.

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state/province/country of residence, and you provide your consent to allow any minor dependents to use this website and our services.

These Terms and Conditions are effective unless and until terminated. A breach or violation of any of the Terms and Conditions will result in an immediate termination of your services. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our services or when you cease using our site.

In no case shall Sophie Zadeh, our employees, affiliates, agents, contractors, suppliers or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of any of our products and services.

Services

We reserve the right but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We also reserve the right to limit the quantities of any products or services we offer.

If there are errors, inaccuracies, omissions, or outdated information on our website or our services, we reserve the right to correct them at any time and without notice. However, we are not obligated to update or correct any errors, inaccuracies, omissions, or outdated information on our website or services.

We endeavour to match descriptions of services to services provided. Descriptions of our services and relevant dates are available on our website. We will provide services with reasonable care and skill and by the service description. 

Occasionally, unforeseen circumstances may prevent a service from following its usual course and website description. We reserve the right to alter the course of a service, including classes, coaching and training, in response to circumstances and attendee behaviour.

Although we endeavour to provide services to the highest standards, we do not warrant that the quality of any information, services, products, or other material purchased or obtained from us will meet your expectations. Results vary between individuals and are influenced by the client/student's participation level. We do not guarantee that you or users of our services will obtain a particular result, qualification, or employment opportunity from purchasing or completing any of our services.

All purchases are final, and we do not offer refunds on services or products for change of mind, injury, illness, or any other reason. We also do not provide refunds if you cannot attend a class because it is at capacity. At our sole discretion, we may provide credit for classes depending on case-by-case circumstances.

Purchases and memberships are non-transferable or interchangeable unless agreed upon.

Fees must be paid in full before participation in any service.

We are not responsible for any fees charged by your bank, debit/credit card, or other provider.

You are responsible for all costs you incur when participating in our services.

Class package coupons automatically expire at the end of their expiry date. Unused coupons cannot be transferred or carried over. We do not extend class package coupons if unused within the specified date. In exceptional circumstances, an extension may be granted at our sole discretion.

  • 4 class packages expire 183 days from the date of purchase

  • 8 class packages expire 183 days from the date of purchase

  • Unlimited class packages expire 183 days from the date of purchase

Online classes and one-on-one appointments can be booked, rescheduled, or cancelled up to twenty-four hours before class starts. Cancellations and no-shows after this time will be classed as attended, and we are unable to offer a refund. We request that classes be booked, rescheduled, or cancelled as soon as possible before the start time to enable the space to be utilised by another person. 

We may need to cancel a class or appointment if it is under-booked or unforeseen circumstances arise. We will inform students or clients as soon as practical and refund the fee or credit client accounts, as appropriate or applicable. Undersubscribed classes may be discontinued. 

We cannot guarantee against disruption to services provided, including discontinuation of services, prices, break in software use, unstable internet connection or technical failure. 

Adults are not permitted to attend children's classes; however, parents or guardians can be present to support and assist if necessary.

Minors are not permitted to attend adult classes. However, in some circumstances, at our sole discretion and after prior suitability discussion, minors may be admitted into adult classes if accompanied by an adult.

Class participants are occasionally photographed or videoed for promotional purposes. We'll provide an option to opt out upon enrolment.

Parents/guardians are responsible for the safety of minors during participation in online classes and courses. 

Some lessons and other content include exercises and activities, including, but not limited to, voice, breathing, and mindfulness, that, if done in the wrong way, may cause harm. As the purchaser of our services or consumer of our content, it is your responsibility to ensure your safety and the safety of the participants under your care, including but not limited to being present during the exercises and activities and discussing suitability with a doctor before participation.

To keep students safe, ensure effective learning, and avoid class disruption, parents/guardians must inform us of any existing medical or behavioural conditions and allergies for in-person classes and courses and any known or suspected behavioural conditions for online classes. In some cases, it may be necessary for parents or carers to attend the session.

Participants with additional needs are welcome to attend with a parent/guardian after a suitability discussion with Sophie Zadeh. Some of our venues may have access limitations; please get in touch with us before enrolment.

To keep students safe during in-person classes for children, parents/guardians must drop off and collect participants on time from the venue unless otherwise arranged. Parents/guardians must be contactable during the session in case of an emergency. Participants are required to bring a bottle of water with a closable lid.

Participants of in-person classes for children must be able to take themselves to the toilet and use it without assistance or must bring a parent or guardian to assist.

Unlimited lifetime access to online courses means students can access the course anytime, for as long as the course exists.

Single Student Annual Subscription course packages (Bronze, Silver and Gold) are strictly for single students only. The Platinum package provides family access for multiple students from the same family. Student names must be submitted when purchasing a package.

Annual subscriptions can be cancelled and reinstated in the user’s customer account any time.

Classes, workshops, and events are mixed-age/ability within an age range. As such, variation in class dynamics is natural and unpredictable. Mixed-age/ability classes promote inclusivity, tolerance, patience, and emotional maturity, and assist in efficient and sustainable practice. Refunds are not provided if a student refuses to attend a class based on the age or ability of other students.

Confidentiality

Each party shall keep the other party’s confidential information strictly confidential.

Either party may disclose confidential information to its legal and other advisors to acquire advice.

Information supplied by our clients is not disclosed to anyone outside of our business, with the exception of third-party controllers of information conducting processes on our behalf. These entities include, but are not limited to, payment processors, analytics services, and marketing services. For more information, see our Privacy Policy.

Information disclosed by our clients/students during coaching, training, classes, and for behaviour analysis remains strictly confidential. It is not used for any purpose other than to complete the service provided. 

Behaviour and Conduct

We reserve the right to suspend or refuse service and terminate the enrolment of anyone at any time whose behaviour we deem to be unacceptable, including, but not limited to, harassment, discrimination, abuse, intimidation, and/or disruptive behaviour interfering with the learning and enjoyment of other students.

Class participants are expected to behave and be nice to one another. Disruptive behaviours and bullying will not be tolerated. Sophie Zadeh endeavours to include students with behavioural conditions and problems, and learning difficulties, including, but not limited to ADHD, Autism and poor attention span. However, behavioural conditions or potential behavioural issues must be communicated to Sophie Zadeh before enrolment in a class to mitigate class disruption. In such cases, modification of learning is possible and/or parents/guardians can attend as support. 

If during a class or other group event, behaviour is deemed to be inappropriate or unacceptable and cannot be resolved, including but not limited to disorderly, disruptive, aggressive, offensive, anti-social or dangerous conduct, we reserve the right to, with any participant, at any time, refuse entry, terminate enrolment and/or eject the participant from the building/online class. Participants will be charged for any damage caused by their conduct to another person, the building or equipment.

Clients/students assume full personal responsibility for the consequences of their activity/behaviour, and Sophie Zadeh waives all liability of claim.

Intellectual Property

All intellectual property rights in website and course content, classes, speeches, training, and behaviour analysis reports are, and remain, the intellectual property of Sophie Zadeh, whether adapted, written for or customised for the client or not. 

You agree not to infringe upon or violate our property rights, including, but not limited to, written text, spoken word, and images/video/illustration documentation.

You are not authorised to:

  • Copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any website or service content, including course materials and resources, without express written permission from Sophie Zadeh.

  • Record, document or relay any part of classes, courses, workshops, speeches, training or coaching without express written permission from Sophie Zadeh.

Upon purchase of an online class or course, you are granted a limited, non-transferable, non-exclusive license. This license is solely for the purpose of the enrolled student to complete or attend the class or course.

Prohibited Uses

In addition to other prohibitions set out in the Terms and Conditions, you are prohibited from using our website, content and services: 

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of our users, students and clients.

  • To submit false or misleading information.

  • For any unlawful purpose or to violate any international, federal, provincial or state regulations, rules or laws.

  • To harass, insult, abuse, harm, slander, disparage, defame, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability

  • To upload or transmit viruses or malicious code that will or may affect the functionality or operation of our website or services.

  • To interfere with or circumvent the security of our website, services, users and clients.

  • To collect or track our personal information or the personal information of our users, students and clients.

User Comments and Feedback

We are under no obligation to maintain confidence, pay compensation, or respond to any comments, feedback, suggestions, or proposals.

Content that we determine to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable may be monitored, edited or removed at our sole discretion.

You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments you or any third-party posts.
